1. Definitions
For the purposes of these Terms and Conditions
Company (referred to as either "the company", "We", "Us" or "Our" in this agreement) refers to MotoXpress.
Customer (referred to as "You"or "Your" ) refers to the individual (a natural person) or company engaging MotoXpress services.
Service (referred to as "Services" or "Service") refers to the transportation/carriage of a customer’s goods or items.
Act refers to the Carriage of Goods Act 1979.
Unit of goods (referred to as “Item” or “Items”) refers to each separate item given to the carrier (e.g. one motorcycle).
2. Booking and Payment
a. To make a booking you must contact MotoXpress by email (kane@motoxpress.co.nz) with the following information:

Your name and contact number

Name and contact number of the person to deliver to (if it is not you booking)

Item description (e.g. Motorcycle) and item type (e.g. sport bike, classic)

Pick up location, date and time (specific if known).

Delivery location, date and time (specific if known).

Other important information about the item we should know about such as modifications, whether the bike has saddle bags attached, correct entrance, gate codes, animals onsite etc.
b. If you would like to book express or overnight delivery of an item, depending on distance from our home base in the North Waikato, this may incur an extra fee, especially if we are returning empty.
c. Full payment is required before your booking can be confirmed, unless otherwise agreed prior in writing with us.
d. We will send an invoice to the email address you provide for payment to be made. Payment can be made by you via internet banking or online card payment. Internet banking payment details are stipulated on the invoice (ensure you use reference number for payment as found on bottom of the invoice). Please note, if you choose to pay online card, a 2.49% convenience fee will be added, and this is not set by us.
e. If the pickup and/or delivery is outside of the main centres, depending on the planned transport route, this may incur an additional fee. We may agree to meet in appropriate public central locations (as determined by MotoXpress) for pick up/delivery, however. this must be agreed prior in writing with MotoXpress.
3. Collection and delivery
a. After full payment is received, we will advise you of the collection/delivery date and approximate time for collection/delivery. Collection and delivery dates are subject to change.
b. While we strive to meet delivery timelines, unforeseen circumstances may cause delay. We are not liable for such delays.
c. Collection and delivery timeframes must be respected due to transportation schedules. Delays in excess of 30 minutes, where you are at fault, may incur additional fees at a value set by MotoXpress.
4. Cancelation
a. Once a booking has been made and paid for in full, any cancelation will incur a $55.00 (including GST) administration fee. This means that we reserve the right to refund your booking amount less the $55.00 (including GST) administration fee.
b. Where a booking is cancelled within 48 hours of date due for collection, a 50% cancelation fee will apply. This means that we reserve the right to refund 50% of your booking only.
c. Refunds are endeavoured to be made as soon as possible after cancelation. You must provide MotoXpress with verification of bank account number (e.g. screenshot or bank letter) for the refund to be processed to.
d. Termination of services - we reserve the right to terminate our services or refuse carriage for any customer engaging in unlawful or unethical practices. If this is the case, no refunds will be made.
5. Liability
a. Items for carriage shall be at ‘limited carrier’s risk’, as set out in the Act, unless otherwise stated. This means that our liability is limited to $2,000 (including GST) per unit of goods as set under the Act.
b. Items stipulated by us as ‘at owners risk’ means no compensation will be paid by us for any breakages, losses, or damage. If the items for carriage are stated as ‘at owners risk’, it is acknowledged, agreed, and declared by you that the carriage is at the ‘owners risk’. Given the limitation we strongly recommend that you organise insurance cover for the transit of your item/s.
c. We make no representations as to the suitability or appropriateness of your insurance policy.
d. We are not liable for loss or damage directly resulting from (not limited to) an inherent defect in the item, items that were not properly prepared and packed, items that were taken from us by a legal process and/or where we were saving or trying to save life or property.
6. Transportation/carriage
a. All items for carriage must be clean and free from any debris and mud.
b. All items for carriage must be suitably packaged and labelled.
c. Additional goods for carriage: We allow one small box for carriage with the item you are having transported (e.g. clothing, helmet, spare part). This must not exceed 15kgs. The additional goods for carriage are carried by us ‘at owners risk’ and MotoXpress take no responsibility or liability for the additional goods for carriage.
d. Additional goods for carriage must be suitably packaged and labelled. The label must state the senders name, item the goods are traveling with, name and address of receiver and state the nature of the goods. Failure to safely and properly package or label goods for carriage is therefore ‘at owners risk’ and we hold no liability.
e. We may carriage extra goods for you if agreed in advance by MotoXpress and this may incur an additional fee at a value set by MotoXpress.
f. No one piece of additional goods is to exceed 15kgs.
g. We reserve the right to refuse carriage of items that are not clean and free from debris and mud and additional luggage that exceeds 15kgs.
h. We will not accept any hazardous goods, this includes any noxious, dangerous, or inflammable goods or goods likely to cause damage or which it is unlawful to carry.
i. It is your responsibility to ensure fuel and fluid caps are secure and there are no leaks prior to carriage. A cleaning charge (approximately $50.00 including GST) will apply for clean-up of any fluid spills, and this will be payable to us upon delivery or via invoice before delivery.
7. Force Majeure
a. We are not liable for any failure or delay in service performance due to circumstances beyond our control, including but not limited to natural disasters, pandemics, strikes, government actions, unplanned road closures or diversions.
8. Acceptance
a. Upon making full payment and/or engaging our services, you are deemed to have acknowledged and accepted these Terms and Conditions.
We reserve the right to update these Terms and Conditions, and these will be loaded to here on our website.
